USER AGREEMENT
Parties
1.1. This user agreement ("User Agreement") has been concluded between Ahmet Ersoy ("Bisaat"), Oruçreis Mah. Tekstilkent Cad. Tekstilkent B6 Blok No:60 Esenler/İstanbul, and the User ("User") to determine the conditions for the User to benefit from the services offered by Bisaat.
1.2. When you create your account, the information you provide must be accurate and complete. The User declares and undertakes to compensate Bisaat immediately and in kind for all damages it may incur due to the inaccuracy of this information.
1.3. Bisaat and the User shall be referred to individually as "Party" and jointly as "Parties" in this User Agreement.
Subject
2.1. Please read these terms carefully before using our services. By using Bisaat Services, you agree to the User Terms of Service, Disclosure Statement & Privacy Policy.
3. Age Restrictions and Membership Conditions
3.1. You may use Bisaat only if you can make a legally binding contract, that is, if you have the legal capacity.
3.2. In addition, persons under the age of 18 are not allowed to use or access Bisaat in any way.
4. Intellectual Property Rights
4.1. All titles, property rights and intellectual property rights related to the products and all copies included in Bisaat (including, independently or collectively, without limitation, all texts, graphics, music or sounds, all messages or informational elements, fictional characters, names, themes, objects, stage arrangements, costumes, effects, dialogues, slogans, locations, characters, schemes, concepts, choreographies, videos, audio-visual effects, domain names and other elements that are part of the Product) are the property of Bisaat or its licensors.
4.2. Bisaat and its content are protected by national and international laws, copyright treaties and agreements, and other laws. Bisaat may contain certain licensed materials, and in such cases, Bisaat's licensors may protect their rights in the event of any infringement. Reproduction or presentation of these licensed materials in any form and for any reason is prohibited without the prior consent of Bisaat and its representatives. Except as expressly provided in this Agreement, all rights not expressly granted to you herein are expressly reserved by Bisaat.

6. PROTECTION OF PERSONAL DATA
6.1. Bisaat shall not transfer or disclose to third parties any personal data it has learned, obtained or will obtain from the User within the scope of this Agreement without the prior express written consent of the User or without meeting the conditions specified in the relevant legislation, and shall not be used for purposes other than the purpose of its commercial relationship. This obligation shall continue after the commercial relationship ends.
6.2. Bisaat undertakes to process the personal data in question in accordance with the law and the rules of honesty, only for the purpose of performing this Agreement and in a manner that is related, limited and proportionate to this purpose, and to store it for the period necessary for the purpose. Bisaat will destroy this personal data in accordance with the legislation in the event that the commercial relationship is terminated or if the purpose of use of the relevant personal data has been eliminated before that date.
6.3. Bisaat will take the necessary technical and administrative measures to prevent the unlawful processing of personal data learned or obtained within the scope of the Agreement, to prevent unlawful access to personal data, and to ensure the preservation of personal data in order to ensure the appropriate level of security.
6.4. Personal data received from Users may be transmitted to other Users and/or Sellers who may be parties to the dispute, in disputes between Users and/or Sellers regarding forgery, fraud, misuse of Bisaat, and issues that may constitute a crime within the meaning of the Turkish Commercial Code No. 6100, only limited to the requested subject, in order for the parties to exercise their legal rights, provided that the relevant person is informed in advance, if necessary in accordance with the Law on the Protection of Personal Data No. 6698 and in any case subject to the data transfer rules.
6.5. The User accepts and undertakes to immediately notify Bisaat in the event of any unauthorized access or improper transfer to the personal data transferred by Bisaat, to cooperate with Bisaat to minimize the damages that may arise from this situation, to eliminate the damages that arise, and to provide all kinds of information, documents and support requested by Bisaat without delay.

7. Prohibited Uses
7.1. The User accepts and declares that he/she will act in accordance with the provisions of this User Agreement, all conditions specified in Bisaat, applicable legislation and ethical rules in the transactions and correspondences he/she carries out on Bisaat. The User shall be legally and criminally responsible for the transactions and actions he/she carries out within Bisaat.
7.2. Bisaat may share the information it holds with the relevant authorities upon request of the competent authorities in accordance with the applicable legislation, by informing the User in advance if necessary in accordance with the Law on the Protection of Personal Data No. 6698 and in any case subject to the data transfer rules.
7.3. The username and password information required by the User to access the My Account Page and to perform transactions via Bisaat are created by the User, and the security and confidentiality of such information are entirely the responsibility of the User. The User accepts, declares and undertakes that the transactions made with his/her username and password are carried out by him/herself, that the responsibility arising from these transactions belongs to him/her in advance, that he/she cannot raise any defense and/or objection that he/she did not perform the transactions and transactions carried out in this manner and/or that he/she will not avoid fulfilling his/her obligations based on this defense or objection.
7.4. The User shall not use Bisaat in a manner that is against the law and morality, primarily in the following cases:
a. Using Bisaat to create a database, record or guide on behalf of any person;
b. Using Bisaat for the purpose of disrupting, changing or reverse engineering all or part of it;
c. Making transactions using false information or another person's information, creating fake User accounts using false or misleading personal data including false or misleading residence address, e-mail address, contact, payment or account information and using these accounts in a manner contrary to the User Agreement or applicable legislation, using another User's account without permission, becoming a party or participant in transactions by impersonating another person or under a false name;
d. Using comment and rating systems for purposes other than Bisaat or in a manner that manipulates systems;
e. Spreading viruses or any other technology that harms Bisaat, Bisaat's database or any content on Bisaat;
f. Collecting any information about Users or Sellers, including e-mail addresses, without the consent of the relevant persons or engaging in other practices that would constitute a violation of Law No. 6698 on the Protection of Personal Data;
g. Activities that will create unreasonable or disproportionately large loads on communications and technical systems determined by Bisaat or that will harm technical functioning,
h. Using automatic programs, robots, web crawlers, spiders, data mining and data crawling, such as "screen scraping" software or systems on Bisaat without the prior written permission of Bisaat, and copying, publishing or using all or part of any content on Bisaat without permission in this way;
i. Using the Services, campaigns and advantages offered on Bisaat with bad intentions and for the purpose of gaining unfair benefit, violating the campaign terms with bad intentions.
7.5. The User is obliged to carry out the transactions he/she performs on Bisaat in a way that will not technically harm Bisaat in any way. The User shall ensure that all information, content, materials and other content he/she will provide to Bisaat are free from any program, virus, software, unlicensed product, trojan horse etc. that will harm the system. The User accepts and undertakes that it has taken all necessary precautions, including using the necessary protective software and licensed products, to prevent the use of such software. The User also agrees that it will not enter the Account Page with robot or automatic login methods.
8. APPLICABLE LAW
This Agreement shall be interpreted and implemented under the laws of the Republic of Turkey; In the event of any dispute that may arise from these agreements or the terms of the agreement, the Izmir Courthouse Courts and Enforcement Offices shall have jurisdiction.
9. TERMINATION
9.1. The Parties may terminate the Agreement at any time and for any reason.
9.2. This Agreement shall automatically terminate if you fail to comply with any of the terms and conditions of the Agreement.
Promotions
10.1. Sweepstakes, contests, lotteries, surveys, games or similar promotions offered through Bisaat may be governed by rules separate from this Agreement. If you are participating in any Promotion, please review the Promotion Rules and our Privacy Policy.
11. Warranty
11.1. To the extent permitted by applicable law, any third party products are provided by Bisaat "as is," "where available," and "as available," without warranty of any kind, whether express, implied, or statutory.
11.2. Bisaat hereby disclaims and excludes all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and title, with respect to the service, any products, and third party materials.
11.3. While we strive to ensure the functionality, integrity and security of Bisaat, we also do not make any guarantee that it will be up-to-date, complete, accurate or secure or that access to Bisaat will not be interrupted. Bisaat may contain errors, mistakes and materials that violate or conflict with this Agreement.
12. FORCE MAJEURE
Emergence of circumstances beyond the control of the Parties that prevent and/or delay the Parties from fulfilling their obligations undertaken under this Agreement, such as strikes, lockouts, wars, civil wars, acts of terrorism, earthquakes, fires, natural disasters such as floods, etc., will be considered as force majeure and the other Party will be notified in writing immediately following the occurrence of the force majeure. As soon as possible after being subjected to a Force Majeure, the party affected by the said force majeure will provide the other Party with all the details of the Force Majeure and the delay or prevention of its activities.
13. OTHER PROVISIONS
13.1. Bisaat may, at its sole discretion, unilaterally change this User Agreement and any policy, terms and conditions, including the Privacy Policy, at any time it deems appropriate, provided that they are not contrary to the provisions of the applicable legislation, by announcing them on Bisaat. The amended provisions of this User Agreement shall become valid on the date they are announced on Bisaat, and the remaining provisions shall remain in force and continue to have their provisions and consequences. For the avoidance of doubt, this User Agreement cannot be unilaterally changed by the User.
13.2. The invalidity or invalidation of any provision of this Agreement shall not affect the validity of the remaining provisions.
13.3. This Agreement constitutes a whole together with its annexes.
